THRIVE WELLNESS AND AESTHETICS TERMS OF SERVICE

1. Introduction.
These Terms of Service (the “Terms”) constitute a legally binding agreement between you and Thrive Wellness and Aesthetics PLLC, an Illinois professional limited liability company (“Thrive,” “we,” “us,” or “our”), governing your use of our services, website (www.twachicago.com), patient portal, mobile communications, and any other features, content, or applications (collectively, the “Thrive Platform”).
Your use of the Thrive Platform constitutes your acceptance of and agreement to these Terms and our Privacy Policy (the “Privacy Policy”), as well as any policies or rules enacted in the future. These documents collectively form the “Agreement.” By using the Thrive Platform, you agree to comply with all applicable federal, state (including Illinois), and local laws.
We may update these Terms from time to time and will notify you of material changes via our website or email. Continued use of the Thrive Platform after such updates constitutes your acceptance of the revised Terms.
This Agreement contains a binding arbitration clause and waiver of class actions (see Section 17).
2. Overview.
Thrive Wellness and Aesthetics PLLC provides elective health and wellness services, including but not limited to:
You understand that Thrive is not a substitute for primary or emergency care, and you agree not to use our services for urgent or life-threatening medical conditions. In an emergency, call 911 immediately.
Thrive provides services only to clients located in Illinois and does not guarantee access to services outside this jurisdiction.
3. Eligibility.
You must register and maintain a client profile to use most services. You agree to provide accurate, complete, and current information at all times.
You must be at least 18 years of age to use the Thrive Platform or Services. Certain treatments may require you to be 21+.
You may only register on your own behalf. You may not use another person’s account or receive services booked under someone else’s name.
You must disclose relevant medical history before receiving care. You may not undergo injectable or other aesthetic services if you:
Other contraindications (e.g., autoimmune disease, recent surgery, active skin conditions, or use of blood thinners) may disqualify you from certain services.
4. User Accounts.
You are responsible for keeping your login credentials secure. Any use of your account is deemed your responsibility. Inaccurate or fraudulent information may result in account termination.
We may suspend or terminate your access at our discretion, including for:

5. Payment, Billing, and Cancellations.
Thrive is a self-pay clinic. We do not accept commercial or government insurance, nor do we file claims on your behalf. All payments are due at the time of service unless otherwise stated.
No refunds, returns, or exchanges will be provided for services rendered. Deposits are non-refundable unless otherwise agreed.
6. Consent and Treatment.
By receiving services at Thrive, you consent to care provided by licensed professionals acting within the scope of their Illinois licensure. You acknowledge that services are elective and carry risks. You agree to follow all pre- and post-care instructions and notify us of any adverse effects.
7. Mobile Messaging.
By providing your mobile number, you consent to receive texts from Thrive related to appointments, offers, and updates. Standard messaging rates may apply. You may opt out at any time by replying STOP.
8. Telehealth Services.
Telehealth services are delivered via secure, HIPAA-compliant platforms. You understand that telehealth has limitations, and treatment decisions may be constrained without an in-person exam.
9. Disclaimers.
Thrive makes no guarantees regarding results. You assume full responsibility for decisions made regarding elective treatments. You agree to seek independent medical advice for primary care needs and medical emergencies.
10. Indemnification.
You agree to indemnify, defend, and hold harmless Thrive, its employees, affiliates, and contractors from any liability arising out of:
11. Limitation of Liability.
To the fullest extent allowed under Illinois law, Thrive shall not be liable for indirect, incidental, or consequential damages, including loss of income, dissatisfaction with results, or delay of care. In no case shall Thrive’s aggregate liability exceed the total amount paid by you in the 12 months preceding the claim.
12. Termination.
We reserve the right to discontinue services or block access to the Thrive Platform at any time, for any reason, without liability.
13. Dispute Resolution.
All disputes shall be resolved via binding arbitration under the American Arbitration Association in Cook County, Illinois, in accordance with Illinois law. You waive the right to a jury trial and class action.
14. Governing Law.
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Illinois, without regard to its conflicts of law principles.
15. Changes to Terms.
We reserve the right to modify these Terms at any time. Material changes will be communicated through our website or email. Continued use of our Services after updates constitutes your acceptance of revised Terms.
